1. Introduction

These Terms and Conditions govern your use of the website located at www.btbt.co.za and your purchase or use of any course, workshop, assessment, learning material or related service offered by BrainTrust Business Training (Pty) Ltd (“BrainTrust”, “we”, “us” or “our”).

By using this website, submitting an application, enrolling in a course or purchasing any of our products or services, you agree to these Terms and Conditions.

3. Courses and services

BrainTrust provides real-estate education, occupational qualifications, skills programmes, workshops, examination preparation, assessment services and related training products.

The content, duration, delivery method, entry requirements, price and anticipated commencement date of each course will be displayed on the relevant course page or supplied in writing before enrolment.

Certain programmes may require:

  • proof of identity or prior qualifications;

  • workplace experience or employment;

  • submission of a portfolio of evidence;

  • participation in assessments;

  • compliance with QCTO, Services SETA, PPRA or other applicable regulatory requirements; and

  • payment of third-party assessment, examination or certification charges.

Where an external authority controls assessment dates, examination dates, certification or the issuing of results, BrainTrust cannot guarantee the timing of those processes.

4. Accreditation and certification

Where a course is described as accredited, the relevant accreditation or qualification details will be displayed on the course page.

Enrolment does not guarantee that a learner will be found competent, pass an examination, receive a qualification or meet the registration requirements of any professional or regulatory body.

Certificates and statements of results are issued only once the learner has satisfied the applicable academic, administrative and payment requirements.

5. Prices and payment

All prices are displayed in South African rand and will indicate whether VAT is included.

Payment may be made using the payment methods presented at checkout. Online card and related payments are processed securely by Peach Payments or another authorised payment-services provider. BrainTrust does not store complete card details.

An enrolment is confirmed only once BrainTrust has received cleared payment or approved a written payment arrangement.

Where instalments are offered, the learner remains responsible for the full agreed course fee, subject to the cancellation and refund rights contained in these Terms and applicable law.

BrainTrust may suspend access to training, learning materials, assessments or certification where an amount is overdue.

6. Learner responsibilities

Learners must:

  • provide accurate and complete information;

  • meet the stated entry requirements;

  • complete required learning and assessment activities;

  • submit original work;

  • comply with assessment and academic-integrity requirements;

  • behave respectfully toward facilitators, assessors, staff and other learners; and

  • keep login details confidential.

Plagiarism, fraud, impersonation or other academic misconduct may result in disciplinary action, suspension or cancellation of enrolment.

7. Intellectual property

All course material, videos, presentations, assessments, templates, graphics and website content are owned by or licensed to BrainTrust.

Course material is supplied for the registered learner’s personal educational use only. It may not be copied, sold, distributed, uploaded, recorded, published or shared with another person without prior written permission.

8. Course changes

BrainTrust may make reasonable changes to course dates, facilitators, venues, delivery methods or learning material where operationally or academically necessary.

If BrainTrust cancels a course and cannot offer a reasonable alternative, the learner will be entitled to a refund of the amount paid for the cancelled course.

BrainTrust is not liable for changes or delays caused by an external assessment body, regulator, qualification authority or other third party outside its reasonable control.

9. Cancellation and refunds

Cancellations and refund requests are governed by BrainTrust’s Refund and Cancellation Policy, which forms part of these Terms and Conditions.

Nothing in these Terms excludes or limits any right that cannot lawfully be excluded under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable South African law.

10. Privacy

BrainTrust processes personal information in accordance with its Privacy Policy and the Protection of Personal Information Act.

By providing personal information, you confirm that it is accurate and that BrainTrust may process it for legitimate enrolment, training, assessment, regulatory, payment and administrative purposes.

Marketing communications will be sent only where permitted by law, and recipients may opt out at any time.

11. Website availability

We take reasonable steps to keep the website and online learning services available and secure. However, uninterrupted or error-free access cannot be guaranteed.

BrainTrust is not responsible for interruptions caused by internet-service providers, hosting providers, payment processors, third-party systems or circumstances beyond its reasonable control.

12. Limitation of liability

To the fullest extent permitted by law, BrainTrust will not be liable for indirect or consequential loss arising from use of the website or participation in a course.

BrainTrust does not guarantee employment, promotion, registration with a professional body or any particular commercial outcome following completion of a course.

Nothing in these Terms limits liability where doing so would be unlawful.

We will endeavour to acknowledge complaints within five business days and resolve them within a reasonable period.

These Terms are governed by the laws of the Republic of South Africa. The parties submit to the jurisdiction of the appropriate South African courts, subject to any applicable consumer-protection dispute process.

14. Changes to these terms

BrainTrust may update these Terms from time to time. The version applicable to a purchase is the version published or supplied when the learner enrolled, unless a change is required by law.
